Summary

The Alcohol Beverage Licensing Section of the Department of Revenue is responsible for regulating alcohol beverage sales.

Laws & Rules:

Supplier Licensing

Required:  Yes

Name:  Beer/Wine Producer or Importer

Fee:  $400

Expiration:  Aug. 31st of even numbered years

Authorizes a producer (defined in SC Code §61-4-300 as a brewery or winery or a manufacturer, bottler, or importer of beer or wine into the United States) to ship beer or wine by the producer to a point within the state of South Carolina.

Original applications and renewals must be submitted online via the SC ABL portal

Revision Required:  COLA change

Complete and submit form ABL-569 Authorization of Wholesalers and Brands and a copy of the COLA. Or, register through Product Registration Online (PRO). Online registrations are auto-approved. Upon approval of license, a wholesaler agreement must be submitted within 60 days.

Any changes made on the label must be approved by the TTB and the new label must be registered as if it were a new product with a copy of the new TTB approval.

South Carolina does not have a franchise law for wine.

Supplier Reporting Requirements

Required:  Yes

Name:  Wine Importer Report

Due Date:  Monthly, by the 10th

A supplier must file a report of invoices of alcoholic liquor shipments to wine wholesalers in South Carolina with the Miscellaneous Tax Section of the Department of Revenue each month online or by paper. The invoice should show in detail the quantity, type, brand, size, the point of origin and the destination.

A salesperson’s license is not required for wine.

Self-Distribution

Allowed:  No

There are no statutory or regulatory provisions allowing an out-of-state winery to self-distribute.
