Summary

The Nebraska Liquor Control Commission (NLCC) is responsible for alcohol beverage licensing, sales and excise tax collection.

Laws & Rules:

Supplier Licensing

Required: Yes

Name: Class S – Liquor Shipper License

Fee: $1,000

Expiration: April 30th of each year

Class S licenses must be renewed online, paper renewals are not accepted. The renewal period begins on Feb. 1st of each year.

Product Registration

Required: Yes, effective July 1, 2024

Fee:  $20 – new label, $0 – renewal

Expiration:  June 30th of each year.  

Revision Required:  COLA change

Prior to July 1, 2024, Label registration and/or approval for wine products is not required. The NLCC will go live with Brand Registration on July 1, 2024. NLCC will be utilizing a software known as POSSE and can start accepting brand registration applications on May 6, 2024, though no approvals will be granted until July 2024.

A 90-day renewal period will begin annually on April 1st. During that time the holder of the Brand Registration must affirm that the product is still active and is being sold in the State of Nebraska. Failure to do so may result in suspension, cancellation or revocation of the Brand Holder’s license.

Nebraska does not have a franchise “monopoly protection” law for wine.

Due Date: Monthly, by the 15th

File form 7080 – Liquor Shipper Class S on or before the 15th of every month. As of June 1, 2017, P.O. number’s must be reported.

A Permit to Solicit for Future Sales authorizes the permit holder to promote the sale of beer, wine, and spirits through methods such as solicitations, display, advertising and personal contact with licensed retailers and their agent, servants, and employees. A person holding the permit under this regulation may give samples of beer, wine, and spirits to retailers provided the alcoholic beverages first came to rest at a wholesale licensed premise and the state excise taxes paid.

Only employees of an Out-of-State Shipper license holder who are Nebraska residents are required to get this permit. A Permit to Solicit for Future Sales does not require a fee or renewal, however, the person holder and/or shipper license holder must notify the Commission of any changes to the information submitted on the permit application.

There are no statutory or regulatory provisions allowing an out-of-state winery to self-distribute.
