OR EPR Update – temporary glass collection rules adopted
On September 11th, the OR Environmental Quality Commission (EQC) adopted the Department of Environmental Quality’s (DEQ) recommendation for temporary rules modifying regulatory requirements for local glass collection used in the OR PRO/CAA fee-setting process for glass. The EQC passed the rules without providing an opportunity for public comment and the linked rules below are now in effect for 180 days.
DEQ stated that these provisions will also be incorporated into its larger proposed permanent rules package, which is expected to be posted for formal rulemaking in mid-September (date TBD), with the public comment period anticipated to close in mid- to late October. Once the proposed rules are available, we will send them to members of the Recycling Subcommittee for their review and input.
The Department also shared this memo outlining feedback received from its Rulemaking Advisory Committee (RAC) regarding the draft fiscal impact statement for the proposed permanent glass collection rules. Among the concerns raised was the appearance of any certainty surrounding potential fee reductions for glass packaging. CAA specifically requested that any references suggesting potential projected fee reductions not be included in the fiscal impact analysis. RAC members also recommended clarifying that members of the public who pay for recycling and garbage services may ultimately absorb a shift in costs resulting from the proposed changes.
