OAL Expected to Approve SB 54 Proposed Packaging EPR Regulations by May 1

CalRecycle submitted the most recent version of the SB 54 Plastic Pollution Prevention and Packaging Producer Responsibility Act proposed regulations to the Office of Administrative Law (OAL) for review, on March 19, 2026. OAL review is one of the last steps required before becoming final. OAL now has 30 business days to approve the regulations, expected by May 1. The EPR language continues to allow CRV beverage containers to be excluded from the EPR program but not their secondary and tertiary packaging. A list of the OAL regulations under review can be found on OAL’s website here, and CalRecycle’s webpage for the SB 54 rulemaking can be found here.
