Notice for New EPR Packaging Program 15-Day Comment Period from CalRecycle

On Jan. 29th,  CalRecycle announced the start of a 15-day written comment period for new revisions to SB 54, the Plastic Pollution Prevention and Packaging Producer Responsibility Act. The comment period will end on Feb. 13, 2026.

CalRecycle made changes to the proposed EPR program language related to food and agricultural commodities in response to clarifying questions from the Office of Administrative Law (OAL). OAL had been reviewing the language for final approval before becoming law.

CalRecycle stated in the Notice of SB 54 Permanent Regulations 15-Day Comment Period that it is only required to consider comments addressing the new changes to the proposed language during this comment period.

The statutory deadlines for data reporting, registration, fees, and the Producer Responsibility Organization (PRO) plan remain unchanged, as well as the language that exempts CRV beverage containers from the EPR program, but not its secondary and tertiary packaging.
