Summary

The Wyoming Liquor Division (WLD), under the Department of Revenue, is the exclusive wholesaler of wine and liquor and responsible for liquor licensing and enforcement. State law prohibits dry localities.

Supplier Licensing

Required:  No

Wineries are not required to obtain a license, however they must appoint an industry representative (broker) who is licensed by the Division. Effective July 1, 2021, the residency requirement for new and renewing Industry Representative license applicants no longer applies.

Wyoming does not have a franchise law for wine.

Supplier Reporting Requirements

Required:  No

Suppliers are not required to file regular sales reports with the Division.

Sales Representative Licensing

Available:  No

A salesperson’s license is not required; however suppliers must assign an Industry Vendor Representative that is a resident of the state. Suppliers may send salespeople to the state, but they must work directly with their Industry Representative.  Effective July 1, 2021, the residency requirement for new and renewing Industry Representative license applicants is removed.

Label Registration:  Not Required

Excise Tax:  Mark-up Tax Required

Reporting:  Required

Limited self-distribution allowed under the direct-to-consumer process. Licensed Out-of-State Shippers may ship any wine not listed with the Wyoming Department of Revenue Liquor Division directly to any retailer which holds a liquor license. State law requires all listed wines to be distributed solely by the Department of Revenue Liquor Division. The Out-of-State Shipper and the licensed Wyoming retailer are responsible for ensuring only non-listed wines are directly shipped to retailers.

This license requires a $50 fee and monthly reporting and tax payments.
